The UK Supreme Court unanimously ruled on April 16, 2025, that the legal definition of a "woman" under the Equality Act 2010 refers to biological sex, meaning someone born female, and does not include transgender women, even those with a Gender Recognition Certificate (GRC).
The case, brought by For Women Scotland (FWS) against the Scottish government, clarified that "sex" in the Act is binary and tied to biology, not legal certification.
